We invite you to read our terms and conditions of sale ("cgv") before using our website, fursac.com (the "site") and/or making a purchase. Please note that any online purchase implies full acceptance of these terms & conditions.

The terms & conditions apply between you, as a consumer and not a professional, and us, Fursac SA, whose registered office is located at 112 rue de Richelieu 75002 Paris, registered in the Paris trade and companies register under number 378 486 096. Please note that these terms and conditions are subject to change as we reserve the right to modify them at any time according to possible changes in the site and/or regulations. We wish to specify that the terms & conditions in force at the time of placing your order will be applicable to you.

1. Your customer account

In order to order on our site, you must create a customer account via the "create an account" section.

Your account allows you to :

  • enter your personal information in order to facilitate your future purchases;
  • consult, modify and update your personal information;
  • identify yourself before placing an order;
  • follow your current orders, to consult the invoices of your former orders.

By ordering on our site, you confirm that you are a private individual, and that you are purchasing our products for personal use in quantities that correspond to the usual needs of a consumer's household. Under no circumstances may our site be used by professional "customers". We reserve the right to refuse an order that is clearly validated by a professional customer.

You are responsible for maintaining the confidentiality of your customer account and password, and for restricting access to your computer or other equipment. As such, you acknowledge that you are responsible for all activities that occur under your customer account. If you suspect that your customer account is being used by a third party, we recommend that you change your password and contact us to close the abused customer account, if necessary.

You also agree to create and use only one account. If you fail to do so, in the event of the creation and/or use of multiple accounts, we reserve the right to close the fraudulent accounts and cancel your current orders.

2. How to order on our website?

You can order your favourite articles directly on our site.

The product offers and prices are valid as long as they are visible on the site, within the limits of available stocks. In case of commercial operations, the duration of the offer will be indicated on the site and in our newsletters. It may happen that our products are temporarily unavailable, and you will be informed of this on the product sheet. We invite you to enter your email address to be alerted as soon as your favourite article is back in stock thanks to our "unavailability alert".

Ordering is easy!

  • Select your items, the size you want and add them to the basket. At any time you can check the number of items in your basket and get detailed information on each of them by clicking on "basket". After adding a first item to your basket, you can continue shopping by clicking on "continue shopping";
  • Once you have completed your shopping basket, click on "order";
  • Log in to your customer account or create your customer account if you do not already have one;
  • Choose the delivery method you want and fill in your delivery address;
  • Choose your method of payment (see below the article "how to pay for your order? for more information on payment methods), read and accept all the terms and conditions and proceed with the secure payment of your order. Payment of your order implies full acceptance of these gcv. If you have an advantage code, please note that it can only be used for a purchase made through the account for which the code was offered;
  • Your order is validated! you will receive an email confirming your order.

By placing an order, you declare that you are at least 18 years old and that you have legal capacity (or if you are a minor, that you have parental authorisation to place your order).

Once your order has been prepared by us, you will receive an email informing you that your items have been dispatched. You will then be able to track the status of your order using the tracking information contained in the email. If you do not receive an email (either confirming or dispatching your order), you can contact us for further information.

There may be times when we have to cancel your order for a legitimate reason, for example

  • when you have been able to place an order but your product is unavailable: we will contact you quickly to inform you of this, and we will proceed, according to your wishes, to the replacement or cancellation and reimbursement of the unavailable product;
  • when a technical error occurs during your payment;
  • when an obvious error has crept into the product file (for example when there is an error on the essential characteristics of the product, or when an obviously erroneous price is displayed);
  • where we become aware of fraudulent or abusive use of your account or related orders;
  • where we reasonably believe that you have breached our terms and conditions

3. The prices of our products

The prices of our products are indicated on the website in euros, all taxes included (ttc) for orders delivered in mainland france. They take into account the value added tax (vat) in force in france and any reductions applicable to our commercial operations in force on the day of your order. 

The customer acknowledges and accepts that the prices of the products are likely to vary between the site and the shops, and that in no case can this price difference be used as a basis for a request for reimbursement, neither total nor partial (apart from your right of withdrawal applicable under the conditions provided below). 

Please note that sales that may be subject to a vat refund must be made directly in the shop. No request for a vat refund will be accepted for purchases made online. 

4. How to pay for your order?

The payment of your order is made directly online by credit card (cb, visa, mastercard / eurocard, american express, bancontact), by paypal, applepay, googlepay.

After confirmation of your payment by our payment provider, your bank account or your paypal account will be debited with the total amount of your order.

We would like to reassure you that all your transactions are secure and comply with the legal provisions in force: they take place within a strict framework of confidentiality and encryption of all your data at our payment provider.

We do not have access at any time to your personal data concerning your means of payment, in particular your bank card, and we do not store them on our servers.

The server and the payment page are secured by s.s.l (secure socket layer) encryption in order to protect all your payment data as effectively as possible.

We reserve the right to refuse payment attempts that have not validated the 3d-secure identification, or that do not come from a verified paypal account.

In order to ensure the security of transactions and to meet the demand for fraud prevention in terms of distance selling, we may carry out random checks on the placing of orders. In this context, we may ask you to provide us with your proof of address and/or identity, the aim being to ensure the reality of your identity before finalising the order.

5. Delivery of your order

5.1 Where and how can you be delivered?

You can have your order delivered by the following methods for a shipping address in mainland France:  

  • For free at home, in the boutique of your choice or in a pickup point. 

  • If you wish to receive your article as soon as possible, opt for express delivery in france, the cost of which will be indicated to you when you place your order; 

You will be able to follow the progress of your order, as soon as you receive the email confirming the dispatch of your order with the information relating to the follow-up. 

If you are absent during the delivery of your order, you will be given a notice to collect your order. If the delivery address is not valid and the parcel is returned to us, you will be responsible for the cost of re-sending the parcel to your new address. 

If you want your order to be delivered outside from France, please click on "Change Region" on the bottom of the website and select the country of your choice. 

Your orders can be delivered to the following countries: France, Germany, Austria, Belgium, Denmark, DOM TOM, Spain, Finland, Hungary, Ireland, Italy, Luxembourg, Monaco, Norway, the Netherlands, Poland, Portugal, the Czech Republic, Romania, the United Kingdom, Sweden, Australia, Canada, South Korea, the United States, Hungary, Japan, Qatar, the United Arab Emirates and Singapore.

 

5.2 When will you be delivered?

When you place your order, the delivery time for your items will be specified. Please note that it may be longer during busy periods (outlet and archive sale or during sales periods for example). Please note that orders placed on the site on a friday after 2pm, on a saturday, sunday or public holiday will be processed on the next working day.

6. What are our return, refund and exchange procedures?

6.1 What are our return policy?

In order to facilitate the return of your products, we grant you a total period of 30 days from the date of receipt of your order to return your products to us, without the need to notify us of your withdrawal beforehand. Our warehouse will accept your return if the postmark proves that you have made your return within 30 days of receiving your order.

This period is more favourable than the european regulation which provides for a withdrawal period of 14 days from the receipt of a customer's order to notify the seller of their wish to return any product which is not suitable. The customer must then return the product without undue delay and at the latest within 14 days of the date of withdrawal.

If you still wish to notify us of your withdrawal, you can use the withdrawal form available here. You must then return your products to us within 14 days of this notification.

6.2 How to return your order?

The products you wish to return must be new (the label on the article must not have been cut), unworn, unwashed, undirty and returned in their original packaging, or failing that, in packaging that guarantees equivalent protection.

To do this, simply fill in the "returns form" included in your parcel and send it back with the product(s) you wish to return to the following address

If our warehouse finds that the product(s) you wish to return are not in conformity, our customer service will contact you to inform you of the return of the product(s) concerned, at your expense.

For all orders delivered in the european union (excluding France), you will be responsible for the return shipping costs.

6.3 When will you be refunded?

Once your return has been verified and accepted by our services, you will receive a refund confirmation email.

For all orders delivered within the european union, you will be refunded the amount corresponding to the product(s) returned as soon as possible and at the latest within 14 days following the date of receipt of your return in our warehouses, or of the provision of a proof of shipment of the latter. For all orders delivered outside the european union, you will be reimbursed for the amount corresponding to the returned product(s) only.

In addition, if you decide to opt for a different method of shipping your return than the one we offer (prepaid label for france), you will still be responsible for the costs of this shipping.

Your refund will be made directly to the account linked to the credit card or to the paypal account used for the payment of the order. You will receive an email confirming the refund once it has been validated by our systems. You will be able to follow the progress of your return directly in your personal space, under the heading "my orders".

Any return of a product that is not new (the label of the article must not have been cut), and which is worn and/or soiled and/or damaged and/or whose label is missing will be returned to you at your expense and will not give rise to a refund.

6.4 Do you wish to exchange your item in shop? (in france only and excluding outlet and archive sale orders)

You have the possibility of exchanging the products you ordered online in a shop. To do this :

  • Go to the shop nearest you (in france only and excluding corners in department stores);
  • Within a maximum of 30 days from the receipt of your order;
  • With the product(s) you wish to exchange. They must be new (the label on the item must not have been cut), unworn, undirty and returned in their original packaging, or failing that, in packaging that guarantees equivalent protection. Failing this, the shop may refuse your return, and you must then keep your products;
  • And bring your order confirmation email, your identity card, and a return form indicating the desired product. The exchange of your item will be made on the basis of the price you paid when ordering online, subject to stock availability in the shop. No refund or credit note will be issued in the shop.

6.5 Do you wish to exchange your item online?

You can request the exchange of your product by indicating the "exchange" option on your return form in the box of your order. Our customer service will create a credit note and then proceed with the exchange with the desired product (subject to availability). The shipping costs of the exchanged product will be at our charge for any order sent to metropolitan france.

We would like to point out that this service may be deactivated during certain commercial operations, of which you will be informed in advance.

7. What guarantees do your products have?

Our products are covered by legal guarantees, i.e. The legal guarantee of conformity and the guarantee against hidden defects. As a seller, we are effectively liable for :

  1. the defects of conformity of the products that you buy, under the conditions of article l.217-4 and following of the consumer code. The legal guarantee of conformity applies when your product presents a defect of conformity, for example when your product does not function in accordance with the uses for which it is usually used, or when it does not correspond to the description given;
  2. and its hidden defects under the conditions of article 1641 and following of the civil code. The warranty for hidden defects covers you when your product has a hidden defect, i.e. A defect which is not apparent at the time of sale and which makes the product unsuitable for its intended use or which significantly reduces this use.

Please note that the legal guarantee of conformity and the guarantee of hidden defects will not be applicable in the event of misuse of your products or failure to comply with the maintenance conditions provided on our labels or by our alterers.

if you are acting under the legal guarantee of conformity, you :

  • have a period of two (2) years from the delivery of the product to act;
  • can choose between repairing or replacing the product, subject to the cost conditions set out in article l217-9 of the consumer code;
  • are exempted from proving the existence of the lack of conformity of the goods during the twenty-four (24) months following the delivery of the goods, except for second-hand goods for which the period is six (6) months.

The legal guarantee of conformity applies independently of any commercial guarantee that may have been granted.

You may decide to invoke the guarantee for hidden defects as defined in article 1641 of the civil code. In this case, you may choose between the cancellation of the sale or a reduction in the sale price in accordance with article 1644 of the civil code.

8. Your personal data

We treat your personal data with the utmost care and confidentiality.

9. Liability and force majeure

We undertake to describe the products we sell on the site as accurately as possible and to ensure that the information published on the site is updated as far as possible.

We shall not be held liable in the event of a breach of any of our contractual obligations resulting from a case of force majeure as defined by the regulations. In particular, we will not be held responsible for any non-performance or delay in the execution of your orders caused by events beyond our control, such as :

  • strikes, closures or other industrial actions
  • civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (declared or undeclared), or threat or preparation for war;
  • fire, explosion, storm, flood, earthquake, subsidence, epidemic and pandemic or other natural disasters;
  • inability to use transport by rail, ship, aircraft, road or other private or public means of transport
  • impossibility of using public and private telecommunications networks;
  • acts, decrees, legislation, regulations or restrictions of any government (e.g. Administrative closure of shops);
  • failure or accidents in maritime, postal or other transport.

The execution of the gcvs will be suspended for as long as the case of force majeure lasts and the execution and delivery deadlines will be extended accordingly. Please note that we will do our utmost to put an end to the case of force majeure or to find a solution that allows us to fulfil our contractual obligations despite the case of force majeure.

10. eco-organization

Please note that we are registered with the eco-organisation and up to date with our eco-contributions under the following unique identifiers
- FR209587_01APPR, issued by ADEME and communicated by CITEO, whose objective is to facilitate the monitoring and control of compliance with EPR (Extended Producer Responsibility) packaging obligations;
- FR209587_11QMZT, issued by ADEME and communicated by Re_fashion, whose objective is to facilitate the monitoring and control of compliance with EPR obligations (Extended Producer Responsibility) for textiles, shoes and household linen.

11. And if we disagree?

We don't want to, but it can happen that we disagree!

Please note that our terms and conditions are subject to french law, and that your orders are subject to the terms and conditions in force on the day of your order.
